1. Introduction & Acceptance

1.1 These Terms & Conditions ("Terms") govern your use of the Atomik website, as well as all quotes, supply of raw sheet materials (e.g., acrylic, ACM panels, plywood), and custom laser cutting, engraving, and manufacturing services provided by Atomik.

1.2 By accessing our website, placing an order, or approving a custom manufacturing quote, you agree to be bound by these Terms.

2. Orders & Quotes
-
2.1 Material Orders: Orders placed via our online store for raw materials or stock items are binding upon our written confirmation or dispatch of goods.

2.2 Custom Services: Quotes for custom laser cutting, engraving, or fabrication are valid for 30 days from the date of issue unless specified otherwise in writing.

2.3 Proof Approval: For custom jobs, production will not commence until the customer approves the artwork/vector file, proof, or specifications in writing. Atomik is not liable for errors (such as spelling, sizing, or design flaws) present in customer-approved digital proofs or customer-supplied files.

3. Pricing & Payment

3.1 All prices listed on our website or quoted are in New Zealand Dollars (NZD) and, unless stated otherwise, exclude GST and delivery charges.

3.2 Payment for online store orders must be made in full at checkout via approved payment methods.

3.3 For custom trade or approved commercial credit accounts, payment is due in full by the date specified on the invoice (e.g., prior to dispatch or by the 20th of the month following invoice date).

3.4 Atomik reserves the right to adjust prices prior to order confirmation in the event of supplier material price increases or technical errors on the website.

4. Custom Fabrication & Vector Design Specs
-
4.1 Customer-Supplied Artwork: You are responsible for ensuring that vector files (DXF, AI, SVG, PDF) provided to Atomik are dimensionally accurate, scaled 1:1, and correctly formatted for laser processing.

4.2 Material Variations: Raw materials such as plywood, timber, ACM, and acrylics may exhibit natural grain, color batch differences, sheet thickness tolerances (+/- 10%), or minor surface characteristics inherent to raw manufacturing. These variations do not constitute defects.

4.3 Kerf & Thermal Tolerances: Laser cutting involves heat-based cutting methods. Minor burn marks, laser flashbacks, or kerf width variations are natural outcomes of the process.

5. Shipping, Delivery & Collection

5.1 Delivery dates provided are estimates only. Atomik is not liable for delays caused by third-party freight carriers or courier services.

5.2 Inspection on Delivery: Customers must inspect delivered sheet goods and custom products immediately upon receipt. Any damage incurred during transit must be reported to Atomik in writing within 48 hours of delivery, accompanied by photographs of the damaged items and original packaging.

5.3 Local Pickup: Items selected for collection from 80 Gracefield Road, Lower Hutt, must be collected within 14 business days of notification that the order is ready, unless prior arrangements are made.

6. Consumer Guarantees Act (CGA) & Business Exclusions

6.1 Consumer Sales: If you purchase goods or services from us for personal, domestic, or household use, nothing in these Terms contracts out of or limits your rights under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA).

6.2 Business Transactions: If you acquire goods or services from Atomik for the purposes of a business (in terms of Section 43 of the CGA), you agree that the provisions of the Consumer Guarantees Act 1993 do not apply.

7. Returns, Refunds & Cancellation

7.1 Custom Goods: Due to the bespoke nature of laser cutting, engraving, and custom-cut sheet orders, no returns, refunds, or exchanges are accepted for custom-made products unless the product is defective or fails to meet CGA statutory guarantees (where applicable).

7.2 Stock Items / Sheet Materials: Returns on un-cut stock sheets or standard catalogue items are at Atomik’s discretion and may be subject to a 15% restocking fee. Returned items must be unused, in original protective film/packaging, and returned at the customer's shipping expense.

8. Intellectual Property & File Storage

8.1 Customer IP: You warrant that any logos, graphics, trademarks, or design files provided to Atomik do not infringe on any third-party intellectual property rights. You agree to indemnify Atomik against any claims resulting from IP infringement.

8.2 File Retention: Atomik may retain digital cut files for re-ordering convenience but is under no obligation to maintain backup copies of your design files indefinitely.

9. Limitation of Liability

9.1 To the maximum extent permitted by New Zealand law, Atomik’s total liability for any claim arising out of the supply of goods or services shall not exceed the total amount paid by the customer for the specific order giving rise to the claim.

9.2 Atomik shall not be liable for any indirect, incidental, or consequential loss, loss of profits, or business interruption arising from material defects or delivery delays.

10. Governing Law
-
These Terms are governed by and construed in accordance with the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the New Zealand courts.

11. Overdue Accounts & Debt Collection Recovery
-
11.1 Late Payment Interest: Any invoice or payment remaining unpaid after the due date will accrue interest at the rate of 2.5% per month (or the maximum rate permitted by law) calculated daily from the due date until full payment is received.

11.2 Debt Recovery & Legal Costs: In the event that your account becomes overdue and is referred to a debt collection agency or legal service for recovery, you (the customer) agree to pay and indemnify Atomik for:

All collection agency commission fees, recovery costs, and administrative surcharges incurred; and
-
All legal costs incurred on a solicitor-and-own-client basis to enforce payment or protect Atomik's interests.

11.3 Atomik reserves the right to suspend or cancel any pending orders or further fabrication work until all outstanding invoices, interest, and recovery costs are paid in full.
